In anticipation of the market introduction of highly and fully automated vehicles, regulations for their behavior in public road traffic are emerging in various countries and regions. Yet, as we show using the example of EU and German regulations, these rules are both incomplete and exceptionally vague. In this paper we introduce three traffic scenarios highlighting conflicting ethical, legal, and utility-related claims, and perform a legal analysis with regards to the expected behavior of AVs in these scenarios. We show that (...) the existing regulatory framework disregards the realities of algorithmic decision-making in automated vehicles, such as the incomplete and imprecise perception of their environment and the probabilistic nature of their predictions. Importantly, the current regulations are written in abstract language addressing human interpreters rather than the precise logical-numerical computer code. We argue that the required interpretation and translation of the abstract legal language into the logical-numerical domain is so ambiguous that the regulations as they stand fail to guide or limit automated vehicle behavior in any meaningful way. This comes with significant ethical implications, as the interpretation and translation is unavoidable and, if not provided by regulatory bodies, will have to be performed by manufacturers. We argue that ethical decisions with significant impact on public safety must not be delegated to private companies, and thus, regulatory frameworks need significant improvements. (shrink)

In recent years, Swedish women belonging to a post-migrant generation have made their voices against racism and social inequality prominent within public debate. Engaging in segregated and economically deprived suburbs, these women make use of art in order to counter stereotypical narratives of themselves and their communities. Based on interviews from two research projects, Accessing Utopia and Gendered Islamophobia in Sweden, this article aims to understand the complexities in using art to protest racist structures and stereotypes. In what ways are (...) the young women making room for their own creative expressions in Swedish society, while countering processes of othering? How does the work of representation affect them? What meaning do the women give to the platforms and networks they have been involved in? This article shows that the women’s early experiences of othering and meeting likeminded youths play a central role in order to either enter or create collective platforms where they can creatively engage in expressing their subjectivities and counter society’s controlling images. Projects and platforms such as Revolution Poetry and Swedish hijabis provided collective self-care through support and confidence building among youths from marginalized communities. These platforms can be seen as an artistic homeplace for the interlocutors. The article also shows that the work of representation is sometimes felt as limiting. The activism the women engage in is a deeply personal struggle for self-valuation and seeking ways to live a life on one’s own terms. (shrink)

This work includes all of Descartes correspondence and scientific work, both of which are essential to understanding of the Cartesian enterprise. Le projet de l'edition des oeuvres completes de Descartes (...) a ete lance en 1894 par le Ministere de l'Instruction publique, et entrepris par un comite comprenant entre autre Emile Boutroux, Xavier Leon, Louis Liard, Charles Adam et Paul Tannery. Ces deux derniers, veritables maitres d'oeuvre de ce travail, aides par l'editeur, ne negligerent rien pour pouvoir presenter a l'Exposition universelle de 1900, une edition qui fut digne du philosophe et de son pays. Elle est desormais universellement consideree comme l'edition de reference de l'oeuvre cartesienne et est constamment citee dans les travaux d'erudition. This article studies it from the point of view of Logic, with the purpose of revealing its petitio principii in relation with the analytical judgments. The modern philosophical Skepticism has its origins in the cartesian figure of a deus deceptor orgénie malin that can create ideas in the human mind. The «divine deception» may have precedents in the theological medieval controversy about the contingent nature of the future and the power of God, and particularly on the theological commentaries of the english Dominican Robert Holkot.

In this paper, a general perspective on criteria of identity of kinds of objects is developed. The question of the admissibility of impredicative or circular identity criteria is investigated in the light of the view that is articulated. It is argued that in and of itself impredicativity does not constitute sufficient grounds for rejecting a putative identity criterion. The view that is presented is applied to Davidson’s criterion of identity for events and to the structuralist criterion of identity of places (...) in a structure. (shrink)

A posteriori physicalism is the combination of two appealing views: physicalism (i.e. the view that all facts are either physical or entailed by the physical), and conceptual dualism (i.e. the view that phenomenal truths are not entailed a priori by physical truths). Recently, some philosophers such as Goff (2011), Levine (2007) and Nida-Rümelin (2007), among others, have suggested that a posteriori physicalism cannot explain how phenomenal concepts can reveal the nature of phenomenal properties. In this paper, I wish to defend (...) a posteriori physicalism from this new and interesting challenge, by arguing that a posteriori physicalists have the resources to explain how phenomenal concepts can reveal at least something of what it would take for the corresponding phenomenal property to be instantiated. Within continental philosophy of biology the work of Michel Serres has not received a lot of attention. Nonetheless, this chapter wants to argue that Serres was part of a group of thinkers – together with Jacques Monod and Henri Atlan – that started to think about biology in terms of second-order cybernetics and information theory. Therefore, this chapter aims to do four things. First of all, it maps the relation between Serres and Canguilhem, one that was mediated by authors such (...) as Louis Althusser or Jacques Monod. Secondly, it fleshes out Serres’s own ‘biophilosophy’. I label this alternative tradition as a ‘biophilosophy without a subject’. Finally, this chapter explores the consequences of this alternative biophilosophy through a brief examination of two authors whose work lies in the line of this tradition: René Girard and Bruno Latour. Though at first sight different, they both draw inspiration from this biophilosophy to develop a framework that, paradoxically, ‘jumps over’ the subject. Hence, the reason why biology is neither a prominent theme in Girard’s nor in Latour’s work. This is not because of a lack of biophilosophy, but because of an implicit one: a biophilosophy without a subject. (shrink)

Mobile health (mHealth) technologies for self-monitoring health-relevant parameters such as heart frequency, sleeping patterns or exercise regimes aim at fostering healthy behavior change and increasing the individual users to promote and maintain their health. We argue that this aspect of mHealth supports healthism, the increasing shift from institutional responsibility for public health toward individual engagement in maintaining health as well as mitigating health risks. Moreover, this healthist paradigm leads to a shift from understanding health as the absence of illness to (...) regarding health as the performance of certain rituals in order to project healthiness. By drawing from the analogy between healthiness and traditional virtues, we evaluate the promises made by proponents of mHealth technologies for self-monitoring. We argue that the implementation and use of mHealth risk entrenching existing inequalities and, more particularly, tend to exclude populations situated at the losing end of those inequalities from participating in the quasi-virtue of healthiness. Consequently, the implementation and use of mHealth technologies not only present challenges for social justice but also undermine their primary societal goal—to promote public health. Finally, we offer several suggestions on how to realize the potential benefit of mHealth. (shrink)

This article aims, first, to describe some of the main features of Latour’s actor network theory. Second, it shows how the practice of writing nature could be seen as a precursor to the actor network theory. Third, some Deleuzian and Harman concepts are outlined, which could be useful for future actor network theories. And finally, this work argues that making an actor network theory implies a series of fundamental changes in the practice of literary and cultural studies, as well as (...) in the practice of the humanities and social sciences in general. Since the UN Guiding Principles on Business and Human Rights were adopted by the UN Human Rights Council in 2011, they have diffused into policy frameworks, laws, and regulations across the globe. This special issue seeks to advance the interdisciplinary field of human rights research by examining key elements of the emerging transnational regime for the regulation of business and human rights. In seven original contributions, scholars from political science, law, accounting, and philosophy critically reflect on the theoretical foundations of (...) the UNGPs, they analyze the effectiveness of implementation mechanisms and current regulatory practice, and they advance proposals for the future development of the business and human rights regime. In this introduction, we prepare the ground for these analyses, proceeding in three steps. Firstly, we argue that the adoption of the UNGPs has triggered a norm cascade which requires a distinctive, empirically oriented research agenda focusing on the scope, governance, and effectiveness of corporate human rights accountability norms and instruments. Secondly, we explain how the articles in this special issue contribute to that research agenda by addressing these themes. Thirdly, we provide an overview of the individual contributions and point out avenues for future research. (shrink)

Para explorar las diferencias significativas entre estos dos pensadores, la primera parte de este articulo considerará sus ideas ontológicas. Comenzando con su preocupación común por la multiplicidad, exploraremos el movimiento fundacional de Deleuze hacia diferentes tipos de multiplicidad. La crítica de Badiou a este enfoque estará relacionada con su defensa de los recursos abstractos de la teoría de conjuntos en oposición a las síntesis concretas con las que Deleuze busca comenzar. La segunda parte de este documento explorará las consecuencias de (...) los compromisos ontológicos de Deleuze cuando se trata de la ética del acontecimiento exigido por Badiou. El compromiso de Deleuze con el estoicismo proporcionará el escenario para su explicación de cómo ocurren los acontecimientos y representa una fuente de pensamiento y actividad. En la tercera y última parte se buscará evaluar la explicación de Deleuze sobre el papel de los acontecimientos en situaciones particulares y en las actividades de los sujetos que responden a estos. Esto nos permitirá sacar conclusiones sobre la crítica de Badiou a Deleuze y la capacidad de Deleuze para resistir estas críticas. Argumentaré que Deleuze comparte con Badiou la preocupación de mantener una visión clara del tema como una figura comprometida en la búsqueda de proyectos nuevos e inauditos que responden al llamado de los acontecimientos. David Hollenbach’s introduction explains how the book brings together Christian (mostly Catholic) theologians, human rights activists, humanitarian practitioners, and legal scholars to help us focus on a class of persons referred to as “forced migrants” or “persons needing protection.” These individuals are neither classical “convention refugees” (according to international law definitions) nor are they simply “migrant workers” (in the classical sense) since their basic human rights to security and subsistence cannot [End Page 230] be adequately guaranteed in their home country or region. They do not emigrate merely in search of a higher standard of living; rather, forced migrants enter and settle in foreign lands seeking some sort of “protection” similar to that afforded to “conventional” refugees. More concretely, the book focuses on persons on the move—individuals fleeing violence and the extreme poverty rampant in regions devastated by ecological degradation and natural disasters.Extending the logic of the 1952 Refugee Convention and adapting it to the realities of today, one can argue convincingly that the international community has a duty to protect such persons when their states of origin are structurally unable or unwilling to afford protection (as argued in Susan Martin’s essay). However, paternalistic approaches that diminish rather than augment the agency of local governments and migrants are to be avoided (as maintained in M. Brinton Lykes’ essay). The book helps us reflect on what can be done to guarantee the basic rights of forced migrants not only at the level of international law and institutions but also through domestic and regional policymaking spurred and inspired by both Christian and secular global-humanitarian values. Such values are eminently compatible when applied to this particular issue (see Silvano Tomasi’s contribution). Agbonkhianmeghe Orobator’s essay—which offers insightful reflections (albeit rather general ones) from Christian ethics, ecclesiology, and biblical theology—likewise points to the need for a truly interdisciplinary approach to the issue. The other authors help the book achieve precisely this. Theological ethics finds its own distinctive place and voice in dialogue with a range of perspectives: legal and political sciences and case studies (Frank Brennan, Daniel Kanstroom); philosophical approaches (Arash Abizadeh); and sociological research on particular migrant populations (M. Brinton Lykes, Maryanne Loughry). The book includes essays that integrate case studies, technical reflections, useful summaries of theological principles and doctrines (J. Bryan Hehir, Mary M. DeLorey, and Tomasi), and philosophical stances (Abizadeh, Thomas G. Weiss), and present practical and legal proposals (see Martin’s essay). A stimulating read for scholars and for the general public, the volume provides good training material for faith-based activists and practitioners.The argumentation strategy in many of the essays in Driven from Home is to appeal to the reader’s sense of solidarity with the needy or suffering neighbor. It promotes the virtues of hospitable citizenship and hospitable disciple-ship while carefully trying to convince national and international policymakers to reinforce and expand the international protection regime. Emboldened by the 2005 “Responsibility to Protect” breakthrough at the United Nations, the authors seek to remain acceptable to a wide audience in an atmosphere of resurgent nationalism, nativism, and protectionism. The authors generally avoid harsh critiques of Westphalian models of sovereignty and do not dwell [End Page 231] on the Catholic doctrines of the universal destination of created goods and the (circumscribed) right to immigrate (and not only to emigrate). Prior studies suggest that firms headquartered in areas with strong religious social norms have higher ethical standards. In this study, we examine whether the ethical standards associated with local religious norms influence the M&A announcement returns. We document that the M&A announcement returns of acquirer firms increase with the strength of religious social norms in the area surrounding firms’ headquarters. We also document that the relationship is attenuated when acquirer firms have strong corporate social responsibility credentials, is amplified when public (...) trust that firms act in the best interest of stakeholders suffers a negative shock and when the M&A deal has greater economic significance for the acquirer, and manifests predominantly in the lower tail of the distribution of M&A returns. Our findings are consistent with investor assessments of firms’ ethical standards driving the relationship between local religious social norms and M&A announcement returns. We find no evidence for the competing explanation—that investor assessments of firms’ risk preferences drive the documented relationship. (shrink)

A part son caractère unique, comme série complète de lettres échangées entre deux hommes d’une distinction si différente, elle nous montre avec quelle précaution il nous faut accepter le texte des lettres de Clerselier et le récit de Baillet sur la vie de Descartes en Hollande. Et comme toutes les vies de Descartes reposent finalement sur Clerselier (...) et Baillet, notre Correspondance nous montre qu’il est nécessaire d’examiner à nouveau tout le problème. (shrink)

Se mostrará cómo en su obra Ser y Tiempo se transforma la fenomenología en una filosofía hermenéutica, se profundizará en los conceptos de comprensión, relación e interpretación fundamentales de la fenomenología y hermenéutica, como se presentan en esta obra magistral.
